This workshop teaches managers what they need to know in order to keep themselves and their organizations out of trouble, by using employment practices that are respectful of people and in compliance with a broad array of protective employment legislation. It addresses a variety of practices relating to pre-employment interviewing, performance appraisals, disability regulations, sexual harassment, pregnancy issues, immigration matters, wrongful discharge, progressive discipline, terminations, and a wide variety of other related issues. The course does not intend to turn managers into lawyers, but to give them a set of practical, hands-on techniques for behaving responsibly as a manager.

PURPOSE OF THE WORKSHOP: This half-day course is not intended to turn managers and supervisors into lawyers. Instead, it outlines briefly the seven major sets of laws that affect how employers are required by the government to treat the people who work for them. It sets out in plain language the rights and responsibilities under the law of both employers and employees, and teaches managers how to deal with specific situations that can arise in the everyday running of a business that are affected by these laws. It pinpoints for managers where and how they must take or avoid actions in order to be in compliance with the law, as well as those situations where they should defer action and confer instead with attorneys and HR professionals. Most of all, the course is intended to give managers the self-confidence that they can handle compliance issues when they meet them. It is a basic, practical, down-to-earth workshop.
The Content of the Workshop: The workshop covers these issues:
- Pre-employment Interviewing: This unit teaches managers the questions they can and cannot ask during such an interview, but it also shows all the other actions employers should take to insure that all candidates for employment are treated equitably and fairly. This unit also shows how these practices are linked to the firm’s Affirmative Action and Diversity Management programs as well.
- The Americans With Disabilities Acts: This unit shows managers how to interview disabled candidates, the criteria used in hiring them, and the special provisions employers are expected to provide when they employ them.
- Pregnancy Issues: This unit explores the rights of pregnant employees, and the obligations employers have towards them.
- Terminations: This unit shows the efforts employers are expected to make in regard to failing employees, and the procedures necessary to establish a termination for Just Cause. The unit also explores the characteristics of Wrongful Discharge.
- Discipline: This unit shows managers how to prepare and conduct an effective Disciplinary interview, as well as determining when discipline should be considered as an employment action, and what effective disciplinary actions consist of.
- Privacy: This unit explores the rights of both employers and employees to hold information private, as well as circumstances where both have a right to transparency. The unit specifically addresses privacy issues as they relate to emails, recorded phone conversations, and other forms of electronic communication.
- Immigration: This unit details what kinds of people have the right to work in this country, and what the requirements employers have under law to insure that their workers have legal employment status.
How The Course is Conducted: This course is not a dry recitation of legal facts. It is an interactive course where participants explore the complexities of these subjects with the course instructor and with each other. Small groups work on problems generated by the content and by the instructor, and then solve a dozen mini-cases at the conclusion of the program.
Who Should attend: This course is directed primarily at managers and supervisors in any department or division. It is also a useful course for junior Human Resource professionals who are new to this profession, and for Administrative people who have some Human Resource functions mixed in with their other responsibilities.
